Terms and Conditions
Definitions
- You – means any participant in classes.
- The studio – refers to only Pilates on Collingwood Street, and includes both the reformer and group studio spaces.
- Classes – includes reformer Pilates classes, floor-based classes, training and private classes that form the basis on an exercise program.
- Props – means any pieces of equipment you are directed to use during the course of your class.
- Website – means www.pilatesoncollingwoodst.com.au and any associated pages belonging to this domain.
- Instructor – A staff member of the studio entrusted to carry out class facilitation based on their appropriate level of training.
General Terms
- By signing up to participate in our classes, you agree to be bound by our Terms and Conditions set out below, whether or not a physical document has been signed by you.
- I agree to abide by the rules of conduct, behaviour, dress code, equipment usage (including props) and use of services that are displayed within the studio and that have been provided to me.
- By participating in classes, you are required to set up a booking profile, in doing so you hereby agree to provide information that is true and correct.
- Nothing in these terms and conditions, limit any rights you may have under the Trade Practices Act, Fair Trading Act, any other Commonwealth or State Legislation.
- Any terms or conditions that create an inconsistency with aforesaid legislation are considered void to the extent of the inconsistency.
- You understand that from time to time you may be photographed or recorded at the studio and that these pictures/footage may be published on social media or in promotional materials published by the studio. If you do not wish this to occur, please inform us.
- You understand that health related information once declared may be captured within the studio Client Management System, and used only for safety purposes by your instructors.
- We may change these terms and conditions from time to time without notice to you.
Limitation of Liability
- By attending the studio and participating in classes, you will be performing physical activity / exercise which has an inherent risk of personal injury. Therefore, by participating in classes you acknowledge and accept that risk of injury from such activities may occur during your time in the studio including the use of other equipment. You acknowledge that the risks of these activities may be significant including the potential for injury or death. You knowingly and freely assume all such risks, both unknown and known.
- To help mitigate the risk of injury, it is your responsibility to disclose injury related information, specifically, you are required to inform your instructor if there are any risks to your health by participating in a class. Please provide details that pertain to pre-existing injuries, illnesses, muscle soreness/discomfort or are pregnant, prior to commencement of a class.
- You are advised to seek medical advice prior to commencing any exercise program if you are in any doubt about your ability to engage in exercise at the studio.
- You, your heirs, assigns or legal representatives fully release Pilates on Collingwood Street (and its associated entities, franchisees, members, employees and contractors) from any claim, loss, damage or expense of any kind including in relation to personal injury, property damage/loss, or wrongful death, occurring during classes, whether caused by negligence or otherwise. Furthermore, the same limitations apply for any use or misuse of our public content, including but not limited to our website, Instagram, Facebook or other social media platforms.
- You agree that you are to stop physical activity / exercise and notify your instructor if you experience any pain, discomfort, faintness or dizziness during your class.
- You agree to comply with all directions and guidelines that are given to you during your class by your instructor. Such instruction may include stopping and part-way through a class and not completing the class.
- You accept that your instructor will periodically adjust you by physical means during your class, and if that if you do not wish for this to occur, it is your responsibility to inform your instructor prior to the class commencing.
Introductory Offer (4 for $50)
- The introductory offer is valid for two weeks from the first class and is available for new and local residence clients only.
- This offer includes two reformer classes and three group studio classes and is available for a limited time only.
- Unused class credits cannot be exchanged, are not transferrable nor refundable.
- Extensions are not available to the two week expiry period.
- Pauses/holds during the two week period are not available.
- The studio reserves the right to remove or amend this offer at any time.
- The general cancellation policy applies to this offer.
Class Packs
- All class packs, including the single casual pass, have an expiry which commences at the time of your registration with the booking App. All expiry periods are clearly advertised on both the website and within the booking App.
- Class packs may be purchased for either the reformer or group studio spaces and are not interchangeable.
- Class packs provide access to the reformer studio only unless the packs explicitly state otherwise.
- Unused class credits cannot be exchanged, are not transferrable nor refundable.
- Extensions to expiry period will be considered with a valid medical certificate and will be at the discretion of the studio owner.
- Pauses/holds during the expiry periods are not available.
- The studio reserves the right to remove or amend any class pack at any time.
- The general cancellation policy applies to this offer.
Studio Memberships
- Memberships are limited to group classes conducted in our Reformer and Group Studio space only, and exclude private sessions.
- Memberships are paid in advance on either a weekly or monthly based on a day of your choice (credit card or debit account).
- By purchasing a membership, you consent to the studio establishing a recurring series of payments on your behalf, for the total agreed membership amount.
- A single 2-week ‘break period’ is available for each 6-month membership period, this cannot be taken as two separate 1 week breaks. All requests for membership breaks must be made in writing (in-studio break requests will not be honoured). You will receive an email confirming your membership break period dates when it has been completed. Please note, if you do not receive this email within 48 hours, your request has not been received.
Specific Payment Terms:
- All payments will be managed by the TeamUp payment system, Stripe.
- No transaction fees will be added onto your membership amount.
- It is your responsibility to ensure sufficient funds are available prior to your agreed payment event.
- Payments will be paused for any nominated 2-week ‘break period‘ allowed once for each 6 month membership period. An extra 2 payments will then be added to the end of your membership period.
- Cancelled memberships will continue to incur automatic transactions until the 6 months membership period has finished, unless otherwise agreed (for example, see reasonable membership cancellations).
- You agree that you will have funds available in advance of your scheduled payment, and accept that studio access may be withdrawn where funds are overdue or in dispute.
- No refunds can be awarded once the transaction has been made if you fail to advise within adequate timeframes.
- The maximum classes available within each membership is as follows:
4 CLASSES – REFORMER + GROUP STUDIO: Total of 4 classes per week, 2 classes per studio space
4 CLASSES – GROUP STUDIO: Total of 4 classes of your choice in only the Group Studio space
3 CLASSES – REFORMER STUDIO: Total of 3 reformer classes per week
2 CLASSES – REFORMER STUDIO: Total of 2 reformer classes per week
- Unused class credits cannot be exchanged, are not transferrable nor refundable.
- Unused class credits are also not rolled over to the following week(s).
- Your membership term is 6 months. At 5 months, or anytime thereafter, you can cancel your membership with four weeks written notice.
- You can pause your membership twice a year, however your request must be in writing giving at least two weeks notice.
- All requests for membership cancellations must be made in writing (in-studio cancellations will not be honoured). You will receive an email confirming your membership cancellation when it has been completed. Please note, if you do not receive this email within 48 hours, your cancellation request has not been received.
- Reasonable Cancellations – Pilates on Collingwood Street will consider requests for membership cancellation (without additional payments), for health or financial reasons, on a case-by-case basis.
- Please review class cancellation and no-show policies below.
Prizes & Donations
- All prizes and or donations must be redeemed within six months of being provided, unless stated otherwise.
Bookings
- As class sizes are limited, we require you to pre-book your classes online or via the Pilates On Collingwood Street App to reserve your place.
- Bookings cannot be made via phone, email or other messaging services.
Class Cancellations
- If you book a class and can’t make it, please login to your account to change or cancel your booking.
- Class cancellations cannot be made via phone, email or other messaging service.
- All classes (excluding private classes) require 12 hours notice for cancellations/changes. Any cancellation within 12 hours of your class start time will forfeit the full class credit.
- Private and circuit classes are prepaid packs only and require 24 hours notice for cancellations /changes. Any cancellation within 24 hours of your class start time will forfeit the full class credit.
- We do understand that life can be unexpected, so please discuss your situation with us directly if need be.
No Shows
- If you do not show up for your scheduled class you will forfeit your class credit. Additionally, all membership holders will incur a $10 no-show fee.
Complaints Handling
If you ever have a complaint, please message us at info@pilatesoncollingwoodst.com.au with your complaint and we will do all that is reasonably and practicably possible to assess the merits of the complaint and respond to such complaints within a reasonable time and within a reasonable manner.
Privacy
At Pilates on Collingwood Street, we take your privacy seriously. We do not pass your information onto any other business. If you do not wish to receive email, SMS or mail correspondence from us regarding your membership, special offers or promotions then please send us an email or letter confirming that you wish to unsubscribe for such methods of communication.
